The lawsuits by families who lived near Love Canal and now claim to have health problems are moving back to state court.
U.S. District Judge John T. Curtin cited a lack of federal jurisdiction in ordering the suits, which were initially in state court and later moved to federal court, back to State Supreme Court in Niagara County.
The suits claim residents around the landfill became seriously ill because of exposure to chemical wastes that are supposed to be securely stored at the landfill.
They also point to the excavation of a defective sewer line near the Love Canal containment area that discharged contaminated sediment that included toxic chemicals historically associated with Love Canal.
The families’ allegations have been vehemently denied by city, state and federal officials who oversee the landfill.
