LOCKPORT – Brandon R. McKinney, 31, of Prospect Street, Newfane, pleaded guilty Wednesday to selling heroin and was admitted to the judicial diversion program of court-supervised drug treatment by Niagara County Judge Sara Sheldon Farkas.
McKinney, a second-time felon, was living in Lockport when he sold heroin to a police informant there Oct. 1, police said. He had also been accused of selling cocaine Nov. 21.
The judge warned McKinney that if he washes out of the treatment program, he faces between two and 12 years in state prison for his plea to third-degree criminal sale of a controlled substance. To enter treatment, McKinney passed up a fifth-degree sale charge to which he could have pleaded guilty, with a sentence of no more than four years in prison, to enter treatment.
If he succeeds, his charge will be reduced to a misdemeanor with a probation sentence.
